Terms of Use

These terms are an agreement between you and Sidequest Labs ("we", "us") for your use of the Rarestone app and rarestone.app (together, "Rarestone"). By using Rarestone you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Rarestone.
1. Who can use Rarestone
You must be at least 18 years old to use Rarestone. By using it you confirm that you are.
2. Your use of Rarestone
We give you a personal, non-transferable, non-exclusive license to use Rarestone for your own non-commercial use, subject to these terms. You agree not to misuse Rarestone. For example, don't try to break or overload it, get around usage limits, access other people's data, copy or resell our service, use automated tools to scrape it, or use it for anything illegal.
3. AI results can be wrong
Rarestone uses artificial intelligence to suggest what a rock, mineral or crystal is, how rare it is, where it's usually found and a rough value range. These results are best guesses and are often uncertain or wrong. In particular:
- Value ranges are rough estimates, not appraisals. Don't buy, sell or insure anything based on them; get a professional opinion.
- Rarestone can't confirm whether something is a gemstone, fossil or meteorite. Those need testing by an expert or a lab.
- Some minerals are toxic or hazardous (for example, those containing mercury, arsenic, lead, asbestos or radioactive elements). Never eat, lick or inhale dust from a find, and wash your hands after handling unknown rocks. Don't rely on Rarestone to tell you whether something is safe.
4. Collecting rules and outdoor safety
Rules about collecting rocks, minerals and fossils vary. Collecting is banned in many places (such as U.S. national parks), and private land needs the owner's permission. Places suggested on the map are generated by AI from public information and may be wrong, closed, private or unsafe. It's your responsibility to check access and collecting rules before you go, and to follow them. Rockhounding can involve water, tides, cliffs, quarries, weather and remote areas. Use common sense, and don't use the app while driving or somewhere it isn't safe to look at your phone.
5. Your photos and content
You own the photos you take. You give us permission to process the photo of each rock you tap so we can identify it for you. If you turn on "Share my rock photos", you also give us a worldwide, royalty-free, non-exclusive license to store, use, copy and modify those photos to train and improve Rarestone's identification, for as long as they are stored. You can turn sharing off at any time, and deleting your data removes your shared photos. Only share photos you have the right to share, and please don't photograph other people without their permission.
If you send us feedback or ideas, we may use them without any obligation to you.
6. Subscriptions
Some features may require a paid subscription. Before you subscribe, we show you the price, billing period and any free trial.
- Automatic renewal. Subscriptions renew automatically at the price shown, charged to your payment method at the start of each billing period, until you cancel.
- Free trials. If you start a free trial, you'll be charged when the trial ends unless you cancel before then. We send a reminder before a trial converts.
- Cancelling. You can cancel any time in your iPhone's Settings (tap your name, then Subscriptions) or from Settings in the app. To avoid being charged, cancel at least 24 hours before a trial or billing period ends. Cancelling stops future charges; you keep access until the end of the period you've paid for.
- No refunds. All payments are final and we don't offer refunds, except where the law requires otherwise. Cancelling stops future charges but doesn't refund the period you've already paid for.
- Price changes. We'll tell you in advance before a price change applies to your subscription, and you can cancel before it takes effect.
Subscriptions are sold through Apple's App Store and billed to your Apple ID, and Apple's terms apply to those purchases. Apple handles all App Store billing, so any refund request for an App Store purchase is decided by Apple under its own policies, not by us.
7. Our rights
Rarestone, including its software, design, text and logos, belongs to us and our licensors. We may change, suspend or stop any part of Rarestone, and we may suspend or end your access if you break these terms or misuse the service.
8. Disclaimers
Rarestone is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don't promise that Rarestone will be accurate, uninterrupted or error-free.
9. Limitation of liability
To the fullest extent the law allows, Sidequest Labs will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Rarestone or your reliance on its results. Our total liability for any claim relating to Rarestone is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.
10. Indemnity
You agree to defend and hold Sidequest Labs harmless from claims arising from your misuse of Rarestone, your violation of these terms, or your violation of any law or the rights of others, including collecting where it isn't allowed.
11. Apple App Store
If you downloaded Rarestone from the Apple App Store, these terms are between you and Sidequest Labs only, not Apple. Apple isn't responsible for Rarestone or its content and has no obligation to provide support. Apple's Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms who may enforce them against you.
12. Governing law
These terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Connecticut, unless the law where you live gives you the right to bring it elsewhere. Before filing a claim, please email us so we can try to resolve it informally.
13. Changes to these terms
We may update these terms. If we make significant changes, we'll let you know in the app or by email. Continuing to use Rarestone after the changes take effect means you accept them.
